> The National Assembly scrapped the tax deferral on swapping crypto for MiCA stablecoins by a single vote, against the government's wishes. The budget still has stages to pass.

France's National Assembly has voted to end the tax holiday on swapping crypto for stablecoins, which would let the state tax those gains at its 31.4% default rate on investment profits, [CoinDesk reported](https://www.coindesk.com/policy/2026/10/20/france-s-parliament-approves-vote-to-hit-crypto-to-stablecoin-trades-with-31-levy). The change would apply to trades from 1 January 2027, but it is not law yet.

The margin could hardly have been thinner. Amendment I-3898 to the 2027 budget passed on 16 October by 38 votes to 37, with 25 abstentions, backing a proposal the finance committee had already approved.

## What changes for crypto to stablecoin swaps

Today, French investors who swap one crypto asset for another, with no cash paid in or out, can usually defer the tax until they cash out to euros. The amendment removes that deferral when the coin received is an e-money token under MiCA, the EU's crypto rulebook. In practice that covers the euro and dollar stablecoins most people use to park profits.

- **Before:** sell bitcoin for a stablecoin, owe nothing until you move money to your bank
- **After (if passed):** the gain is taxed at the moment of the swap, at the 31.4% default rate, or on the income tax scale if the investor chooses it
- **Cost basis:** gains would be worked out on the purchase price of the coins sold, using a weighted average for units of the same coin bought at different prices, instead of France's current whole-portfolio method

## Even the government is against it

The amendment passed over the objections of the government. Public Accounts Minister David Amiel asked for it to be withdrawn, saying it was unclear how stablecoins would be defined and how tax officers would trace moves within a portfolio. The finance committee's rapporteur general, Philippe Juvin, said he preferred keeping the deferral because crypto prices swing so much.

Chainalysis' regional sales director for France, Francois Volpoet, warned that the measure could push traders towards DeFi apps, peer-to-peer deals and offshore exchanges that sit outside international tax reporting. The budget still has more parliamentary stages to pass, and the clause can be changed or dropped along the way.

## Why it matters beyond France

Swapping into a stablecoin is how most traders take profit without leaving the crypto world, so the stablecoin step is where tax authorities are now looking. Other governments working out how to tax digital assets will watch whether this survives.

For readers in Pakistan, the direct effect is on Pakistanis who live and trade in France: anyone taxed in France who rotates profits into USDC, EURC or similar tokens should plan for tax at the point of the swap from 2027 if the clause survives.
